Terms of Service
These Terms of Service ("Terms") govern your use of DinnerTap (the "Service"), operated by Wadia, LLC ("DinnerTap," "we," "us"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 18 years old (or the age of majority where you live) to create an account. The Service is not directed to children under 13. You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information and keep it current.
2. What DinnerTap does
DinnerTap suggests dinner ideas based on your household preferences and filters, lets you approve meals for specific days, estimates ingredient costs, and, if you connect a supported grocery account, adds ingredients for approved meals to your grocery cart. You review and complete checkout, payment, and delivery or pickup directly with the grocer.
3. Subscription, billing, and cancellation
The Service costs $2.99 per month (plus applicable taxes), unless a different price is shown at sign-up. Payments are processed by Stripe. Your subscription renews automatically each month and your payment method will be charged at the start of each billing period until you cancel. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, we do not provide refunds or credits for partial months or unused time. We may change pricing with at least 30 days' notice; changes apply to your next billing period after notice.
4. AI-generated suggestions — important disclaimers
Meal suggestions, recipes, ingredient lists, and instructions are generated in part by artificial intelligence and may be inaccurate, incomplete, or unsuitable for you. DinnerTap does not provide medical, nutritional, or dietary advice. You are solely responsible for verifying every ingredient and product for allergens and dietary restrictions, including by reading product labels, even if you have entered allergies or restrictions into the Service. Follow safe food-handling practices and proper cooking temperatures. Consult a qualified professional for medical or dietary needs.
5. Cost estimates
Cost estimates are approximate and based on available product and price information at the time shown. Actual prices, availability, substitutions, taxes, fees, and totals are set by the grocer and may differ. We are not responsible for differences between estimates and final charges.
6. Grocery account connections (Kroger and others)
You may connect your Kroger account through Kroger's official authorization process. We never see or store your Kroger password; we store authorization tokens and your selected store location so we can look up products and add items to your cart on your behalf. You can disconnect at any time. Your purchases are governed by the grocer's own terms and policies. DinnerTap is not affiliated with, sponsored by, or endorsed by The Kroger Co. Kroger and related marks belong to their respective owners. We may add other grocers in the future, subject to similar terms. We are not responsible for grocer services, outages, product selections, pricing, orders, or deliveries.
7. Acceptable use
You agree not to misuse the Service, including by: violating any law; accessing others' accounts; reverse engineering, scraping, or overloading the Service; reselling or sharing your account; or using the Service to transmit harmful code or content.
8. Your content
You keep ownership of the preferences, ratings, and other content you provide. You grant us a limited license to use it to operate, improve, and personalize the Service, as described in our Privacy Policy.
9. Our intellectual property
The Service, including its software, design, logos, and the DinnerTap name, is owned by us or our licensors. We grant you a limited, personal, non-transferable, revocable license to use the Service for your household's non-commercial use.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, or if we discontinue the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) will survive.
11. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DINNERTAP AND ITS OWNERS, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, OR FOR ANY ILLNESS, ALLERGIC REACTION, OR INJURY ARISING FROM FOOD PREPARED USING THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Indemnification
You agree to indemnify and hold us harmless from claims arising from your misuse of the Service or violation of these Terms.
14. Governing law
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Michigan, and you consent to their jurisdiction.
15. Changes
We may update these Terms. If changes are material, we will notify you by email or in the app before they take effect. Continued use after the effective date means you accept the updated Terms.
